Molinel reserves the right to modify these general terms and conditions of sale at any time by publishing a new version on the website. The applicable general terms and conditions of sale are those in force on the date the order is validated. It is the responsibility of the Buyer to print and/or save these terms and conditions.
These general terms and conditions of sale are concluded between Molinel, hereinafter referred to as “Molinel,” and natural persons wishing to make a purchase via the website www.molinel.com. The parties acknowledge that their relationship is governed exclusively by this agreement, to the exclusion of any terms previously available on Molinel’s website.
For the purpose of applying these general terms and conditions of sale, it is agreed that the User of the website and Molinel will be collectively referred to as the “Parties” and individually as a “Party.” The User who validates an order will hereinafter be referred to as the “Buyer.” The rights and obligations of the User necessarily apply to the Buyer.
The User who wishes to make a purchase on www.molinel.com declares that they are over 18 years old and have full legal capacity or have the authorization of a parent, legal guardian, or curator.
Any order of a Molinel item on www.molinel.com implies prior consultation of and express acceptance of these general terms and conditions of sale, without requiring a handwritten signature from the User.
These general terms and conditions of sale apply without restriction or reservation to all sales concluded by Molinel with Buyers wishing to acquire the items offered for sale on www.molinel.com.
Accessible at any time on the website www.molinel.com these terms and conditions of sale shall prevail, where applicable, over any other version or contradictory document.
Unless proven otherwise, the data recorded by Molinel constitutes proof of all transactions.
In accordance with the provisions of the law of March 13, 2000, it is recalled that an order is confirmed once the chosen payment method is validated. This validation constitutes an electronic signature which, between the Parties, has the same value as a handwritten signature and serves as proof of both the completeness of the order and the enforceability of the amounts committed through the selection of items listed on the order form.
Access to the website www.molinel.com is provided under normal Internet connection conditions. No additional connection fees will be charged to the User.
1. Purpose
The Parties agree that these general terms and conditions of sale, having contractual value, exclusively define their relationship on the Internet, as well as their respective rights and obligations in connection with sales carried out via the website www.molinel.com. They govern all necessary steps for placing and tracking orders between the contracting Parties.
If any term of sale were to be missing, it shall be considered governed by the practices in force in the distance selling sector for companies based in France.
2. Products
The products governed by these general terms and conditions of sale are those listed on the website www.molinel.com and subject to sale and shipment by Molinel. They are offered while stocks last.
Products sold by Molinel are presented and described as accurately as possible on the website www.molinel.com. However, if any omissions or errors are found in the descriptions, Molinel’s liability cannot be engaged.
In the event of unavailability of a product sold on www.molinel.com after the order is placed, due to a stock discrepancy, the Buyer will be informed by email as soon as the logistics department provides the information. In case of product shortage, the customer may cancel the order partially or entirely. The refund of the concerned product or the entire order will then be issued in the form of store credit.
3. Prices
The prices of Molinel products are indicated in euros, excluding tax (excl. VAT) as well as all taxes included (incl. VAT). They take into account any discounts and/or rebates applied or granted, as well as the VAT applicable on the day of the order.
The indicated prices are guaranteed while stocks last, except in the case of significant changes in costs (notably VAT) or typographical errors or omissions.
Furthermore, the prices of products sold by Molinel do not include delivery charges. Delivery fees are not charged by Molinel, regardless of the order amount.
If one or more taxes or contributions, including environmental ones, were to be modified or created, this change will be reflected in the sale price of the products presented on the website www.molinel.com.
The costs related to accessing the website remain the sole responsibility of the Buyer.
Finally, Molinel reserves the right to modify its prices at any time. However, products sold by Molinel will be billed based on the prices in effect at the time the order is recorded and subject to the availability of the said products.
If a validated order contains one or more errors (price, description, photo, etc.), Molinel reserves the right to cancel it. The customer may choose the preferred method of refund: bank transfer or store credit.
4. Order
• Identification
To place an order, registration is mandatory. The User must follow the account creation procedure indicated in the “My Account” section of the website. The User must provide all necessary identification information, including first and last name, postal address(es), email, and password. Once the password is entered, Molinel ensures the confidentiality of the submitted data.
The User is responsible for the use of their password and must ensure both its security and confidentiality. In case of loss or forgotten password, the User may request a new one by accessing their account and following the “Forgot Password” procedure. The password will then be sent to the email address provided during registration.
• Order Placement
The order is placed via an Internet connection that allows navigation on the website. It must include all information necessary for its processing and must be made from mainland France or Corsica. Any order constitutes acceptance of the general terms and conditions of sale, as well as the prices and descriptions of products available for sale on the website.
When placing an order, the User selects the desired products and clicks on the “Add to Cart” button.
At any time, the User may:
Obtain a summary of the selected products by clicking on “My Cart.”
Continue selecting products by clicking on “Continue Shopping.”
Complete the selection and finalize the order by clicking on “Checkout.”
To place an order for the selected items in the cart, the User must identify themselves by entering their email and password (if an account has already been created) or by completing the registration form. The User acknowledges and accepts that entering these credentials (email and password) constitutes proof of their identity and confirms their consent.
Once identified, the User must validate the delivery address and will then see a complete summary of the order on their screen. This summary will specify the type, quantity, and price of the selected products, as well as any technical or embroidery fees in the case of customization, and the total price including taxes.
• Final Order Confirmation
After reviewing the details of the order and once all required information has been completed, the User will click on “Checkout” to definitively confirm their order. Molinel will acknowledge receipt of the order as soon as it is validated by sending an email to the address provided by the User.
In case of payment failure, incorrect address, or any other issue encountered on the User’s account, Molinel reserves the right to block the User’s order until the problem is resolved.
If a ordered item is unavailable, the Buyer will be promptly informed by email. Molinel then commits to delivering the concerned item(s) within 6 to 8 weeks. After this period, the customer may cancel all or part of the order and choose the preferred method of refund: bank transfer or store credit.
Any additional order constitutes a new Molinel order. Molinel also reserves the right to refuse or cancel any new order from a Buyer with whom a dispute exists.
For any questions regarding the tracking of an order, the User must consult their customer account on the website.
5. Payment Methods
The User has several options for paying for purchases:
By credit card: In the case of payment by Carte Bleue, Visa, or Mastercard, the User must provide certain information related to the card used:
• Cardholder’s name,
• Card number,
• Expiration date,
• Security code (3-digit number on the back of the card).
It should be noted that with immediate payment by credit card, a payment method offered by Molinel on its website, the User will make the payment via Molinel’s site using the electronic payment terminal system (TPE) of Crédit Agricole. The User’s banking data is transmitted to the bank, which is itself secured by SSL encryption. At no time will the User’s banking information pass through Molinel’s IT system. Molinel’s responsibility is therefore excluded.
By bank transfer: To complete this operation, the Buyer, or the person issuing the transfer, uses the banking details (RIB) provided by the beneficiary, Molinel. The transaction amount is entered, and the transfer of funds is carried out electronically. After processing by Crédit Agricole, the transferred funds are credited to the beneficiary’s account, Molinel. Before making a transfer, the Buyer must ensure that their account has sufficient funds. Otherwise, the transfer order may be rejected.
With their PayPal account: By choosing to pay via PayPal, the User is automatically redirected to their PayPal account. Once the PayPal payment is validated, the User can complete their order on the Molinel website. Once the payment by credit card, bank transfer, or PayPal is confirmed, the order is recorded and becomes irrevocable. The User then becomes the Buyer. The order form is recorded in Molinel’s computer systems, which are stored on a medium that is both reliable and durable. It is considered proof of the contractual relationship between the Parties.
Order confirmation: Once the payment is confirmed, a summary of the Buyer’s order is sent by email to the address provided at the time of the order. This confirmation includes the main details of the order. Molinel recommends that the Buyer keep this confirmation email. However, only documents archived in Molinel’s computer systems will be considered legal evidence. A summary of the order is also available in the customer account.
Payment confirmation: The order is considered valid after confirmation of the bank payment approval. In the event of bank refusal, the order is automatically canceled.
Molinel also reserves the right to refuse any order or delivery in case of dispute with the Buyer, non-payment or partial payment of a previous order by the Buyer, or refusal of payment authorization by banking institutions. Under no circumstances can Molinel be held responsible in case of a dispute.
Payment terms: If the Buyer pays with a debit credit card, their account will be debited within 2 to 5 days following the order. This period may vary depending on the banking institutions. In the case of a deferred debit card, the Buyer’s account will be debited for the order amount according to the usual debit schedule.
Retention of title: In accordance with French law n° 80-336 of May 1, 1980, Molinel products delivered to the customer are sold under retention of title. Ownership of the products is only transferred once the Molinel customer has paid the full invoiced amount. However, the customer is responsible for the Molinel products upon delivery, as transfer of possession equates to transfer of risk.
6. Delivery
Shipping and delivery times: The shipping time for a Molinel order is indicative and starts from the day after the Buyer validates their order, in the case of an order placed after noon (12:00 PM). If the order is placed before noon, the shipping time is shorter, possibly the same day. This time frame cannot be considered binding. In case of unusual delays, an email will be sent to the Buyer.
The average shipping time for products in stock is 48 business hours. Orders placed on a Saturday, Sunday, or public holiday will be processed on the next business day.
In the case of items not held in stock, out of stock, or subject to customization, the delivery time may be extended to 6–8 weeks (3 weeks for a customization). To this period is added the carrier’s delivery time to the shipping address, which is 2–3 business days.
Before confirming their order, the User can view the estimated shipping and delivery times, which are displayed on the “Delivery Method” page.
The estimated shipping and delivery time for a Molinel order is based on the item in the order with the longest shipping preparation time.
Molinel commits to dispatching the order within the estimated time displayed at the time of order confirmation. In the event of non-compliance with this timeframe, Molinel agrees, at the customer’s request, to cancel the sale and issue a credit note as soon as possible.
Molinel reserves the right to suspend delivery if the Buyer’s financial guarantees are deemed insufficient.
Shipping
Molinel reserves the right to choose the most suitable shipping method depending on the weight and volume of the items ordered. Shipments can only be made to mainland France, Corsica, and the French overseas departments and territories (DOM-TOM).
After dispatching their Molinel order, the Buyer receives an email specifying the tracking number of the parcel. This allows them to track their parcel. Items are shipped to the delivery address provided by the Buyer in their customer account. If the Buyer has multiple delivery addresses, they must select one before finalizing the order and proceeding with payment.
Molinel cannot be held responsible for significant delivery delays caused by postal services or carriers in general, nor for the loss of items during transport.
Delivery
For delivery within France or Corsica, parcels are generally delivered:Either by La Poste via Colissimo Suivi to the provided delivery address, from Monday to Saturday, within an average indicative timeframe of 2–5 business days from the date the order is shipped.
Or by a carrier to the provided delivery address within an average indicative timeframe of 24–72 business hours from the date the Molinel order is shipped.
For delivery to the French overseas departments and territories (DOM-TOM), two shipping zones are distinguished:
Overseas Zone 1 includes Guadeloupe, French Guiana, Martinique, Mayotte, Réunion, Saint Barthélemy, Saint Martin, and Saint Pierre and Miquelon. The delivery times for this zone are 3–7 days (average observed time of 5 days, which may be longer in case of customs inspection).
Overseas Zone 2 includes New Caledonia, French Polynesia, the French Southern and Antarctic Lands, and Wallis and Futuna. Delivery times for this zone are 5–14 days (average observed time of 10 days, which may be longer in the event of a customs inspection).
Shipping costs to these two overseas zones vary depending on the total weight of the parcel. Please refer to the table below to know these costs.
Parcels destined for the DOM-TOM are delivered by La Poste via Colissimo Suivi to the provided delivery address, from Monday to Saturday.
To track a parcel sent via La Poste Colissimo, the Buyer must have the parcel tracking number and visit the La Poste website or go to their local post office with a valid ID to obtain more information.
If the Buyer is not present at the delivery address when the parcel is presented, a delivery notice will be left by the carrier in the recipient’s mailbox. The Buyer, with a valid ID, must go to the post office indicated on the delivery notice to claim their parcel within 10 business days.
If the Buyer is unable to collect the parcel within this timeframe, it will be returned to Molinel’s warehouses. The Buyer may request that their order be resent free of charge, but only within mainland France.
However, in the case of input errors, including incorrect or incomplete delivery addresses, Molinel cannot be held responsible for any delays or delivery failures. All costs related to reshipping products due to an error made by the Buyer will be borne exclusively by the Buyer.
In the event of delivery delays, no compensation or penalties will be assumed by Molinel.
Free Delivery
Delivery is free for any order placed on the Molinel website exceeding €69 including taxes. This offer applies to all deliveries within mainland France.Lost Parcel
If within 5 business days after the dispatch of their Molinel order, the Buyer has not received their parcel, nor a delivery notice, nor information via the parcel tracking system, they are advised to visit their nearest post office with the parcel tracking number. This number is available in the confirmation email sent when the items were shipped.
If the carrier cannot locate the parcel, the Buyer must contact Molinel Customer Service as soon as possible, either via the online contact form or by phone. A postal investigation will be opened with the carrier. The Buyer will receive an email specifying all the details and indicating a response timeframe of 10 to 30 days from the opening of the investigation.
If the parcel is found, it will be immediately and freely resent to the Buyer. If the parcel is considered permanently lost, Molinel will resend the client’s order free of charge and in the same configuration, subject to product availability.
Non-Conforming Delivery
Despite careful preparation of Molinel orders, some items in an order may be defective, missing, or non-compliant. Therefore, upon receipt of their Molinel order, the Buyer must check the conformity of the items received and refuse any parcel that is opened, torn, and/or repackaged by the carrier.
Missing items, non-compliant products, damaged parcels… Any delivery issue must be reported to Molinel Customer Service within 8 days of receiving the parcel. Claims made after this period will be rejected by Molinel, which will also be released from any responsibility.
However, upon acceptance by Molinel and if the above conditions are met, Molinel will either refund the defective item(s) or resend the missing item, subject to the validity of the Buyer’s request.
Molinel reserves the right to request that the Buyer return the defective item at their expense. If the defect is confirmed by Molinel’s Quality Service, the costs incurred by the Buyer may be reimbursed by Molinel upon presentation of proof, up to a maximum of 30% of the order amount. Reimbursement will be processed within 72 business hours from the date the parcel is received by Molinel.
7. Promotional Codes
Issuance of Codes
Molinel discount coupons are represented by promotional codes to be entered when placing an order. They may be sent to the User by email or mail during special promotions.
Conditions of Use
Coupons issued as promotional codes cannot under any circumstances be converted into euros. They also have an expiration date that cannot be modified. No new promotional code will be issued or granted to a User to replace an expired and/or unused coupon.
Using a promotional code requires that the cart value exceeds the coupon value, except where the specific terms of use of the coupon indicate a minimum purchase amount. In this case, the cart value must be higher than the required minimum purchase amount to use the promotional code.
A Buyer cannot under any circumstances request that Molinel deduct the value of a coupon from an order that has already been validated and paid if the code was not entered, selected, or is defective. Molinel coupons are only valid on the website www.molinel.com.
Use of Coupons
To benefit from the discount associated with a coupon, the User enters the promotional code they received in the “Have a promo code?” field at the bottom of the Cart page. The discount is immediately applied to the order amount.Refund for an Order Containing a Coupon
When a promotional code has been applied to a Molinel order, the coupon amount is distributed across all items in the order in proportion to their respective values. The refund (in the form of store credit) for an item in an order is made after deducting the portion of the coupon allocated to that item.
8. Warranties and Liabilities
Information About Items
The photographs and images of products displayed on the website www.molinel.com are contractual.Legal Warranty of Conformity for Consumers
Molinel “is responsible for defects of conformity of the goods to the contract under the conditions of Article L.217-4 et seq. of the Consumer Code.”
When acting under the legal warranty of conformity, the client:
Benefits from a 2-year period from the delivery of the goods to take action,
Can choose between repair or replacement of the goods.
However, in accordance with the provisions of Article L.217-9, paragraph 2 of the Consumer Code, the seller may not follow the client’s choice if it results in a manifestly disproportionate cost compared to the alternative, considering the value of the goods or the severity of the defect. In such cases, the seller is required, unless impossible, to proceed with the option not chosen by the Client.
The client is exempt from proving the existence of the defect for 24 months following delivery.
Hidden Defects Warranty (Articles 1641 and 1648 of the Civil Code):
Art. 1641: The seller is responsible for hidden defects of the sold item which make it unsuitable for its intended use, or which so diminish its use that the buyer would not have acquired it or would have paid a lower price if they had known about them.
Art. 1648: Actions arising from redhibitory defects must be initiated by the buyer within two years from the discovery of the defect. In the case provided by Article 1642-1, the action must be brought within one year from the date the seller could be relieved of apparent defects or non-conformities, under penalty of forfeiture.
Molinel guarantees that the items sold are of first quality, shipped in good condition, without defects or hidden flaws making them unfit for normal use. Molinel remains liable for the warranty against hidden defects of the items sold.
To benefit from the legal warranty, the Molinel client must notice any defect upon receipt of the item or within 8 days maximum. The following conditions must also be met :
The defect affecting the goods must be serious. This means it must prevent normal use of the item or reduce its properties to such an extent that the Buyer would not have purchased it, or would have paid a lower price if they had known.
The defect affecting the goods must be hidden. Molinel is not responsible for apparent defects, meaning those that a reasonably diligent person would have discovered through basic checks at the time of receiving the item.
The defect affecting the item must exist prior to the sale, even if it appears later. The Buyer is therefore obliged to exercise caution when using items purchased from www.molinel.com. Proof of a defect caused by negligence, deterioration, or improper use will void any associated warranties.
If all the above conditions are met, Molinel may proceed with the replacement of the item free of charge.
Contractual Warranty
Molinel does not provide any contractual warranty. The lifespan of professional clothing and protective equipment sold by Molinel depends on their usage. No claims will be valid in cases of damage caused by external events, misuse, or failure to follow the prescribed care instructions.
Liability
Molinel’s liability is limited to the amount of the Buyer’s order. Molinel cannot be held responsible for any issues inherent to using a computer, a network, the Internet, service interruptions, external intrusions, or the presence of computer viruses on the User’s device.
Molinel has only a best-efforts obligation for all stages of accessing the website, including browsing, filling out forms, placing orders, making payments, and using the various services available on www.molinel.com.
Molinel cannot be held liable for any material, immaterial, or bodily damages resulting from the misuse of an item purchased on its site.
Returns
Items purchased on www.molinel.com may be returned within 8 days of receipt. After initiating the return on the website in “My Account” under “My Product Returns,” items must be sent back with the return slip, in their original packaging (intact and complete), clean, and in new condition, to the following address:

Upon receipt, the items will be evaluated by Molinel’s Quality Service. Molinel reserves the right to accept or refuse the return of an item if the return is not due to an error on its part. Any package sent without the return authorization slip will be systematically refused. Items returned incomplete, damaged, or dirty will not be accepted.
If the above conditions are met, Molinel will refund the Buyer as soon as possible, either by bank transfer or in the form of store credit, excluding the return shipping costs, which remain the responsibility of the Buyer.
In the event of returns not complying with the above conditions, Molinel reserves the right to apply a 20% deduction. In cases of abusive or abnormal returns, Molinel reserves the right to refuse future orders.
Exchanges are offered to customers who request them when registering their return request on www.molinel.com. Molinel will then be able to ship only once, free of charge, the same item in a different size (smaller or larger), only if it is available in stock at the time of logistical processing of the return. In the case of a price difference between the purchased item and the exchanged item, no refund of the price difference will be made by Molinel.
The costs and risks associated with reshipping the item remain the responsibility of the Buyer. Molinel advises the Buyer to keep all proof of return and to return items via a tracked shipping method, such as registered mail (Colissimo), or by any other means providing proof of shipment. The shipping proof must include: recipient address, shipping date, and parcel number.
In accordance with Articles L. 121-20-2 and L. 121-20-4 of the French Consumer Code, customized items requested by the Buyer are neither refundable nor exchangeable.
Right of Withdrawal
Pursuant to Article L. 222-7 of the Consumer Code, the consumer benefits from a 14-day period to return goods from the date of exercising the withdrawal right; this period can be extended up to 28 days: if the customer exercises the right on the 14th day, they still have 14 days to return the product.
To do so, the customer must express their desire to withdraw by email at contact@molinel.com or via their personal account on Molinel.
When the customer exercises the right of withdrawal, Molinel is obliged to refund the total amount paid for the returned products no later than 14 days from the date it was informed of the withdrawal decision.
Molinel may delay the refund until it has received the goods OR until the customer has provided proof of shipment of the goods, with the date considered being the earliest of these two events.
For simplicity, all customers will benefit from the same right of withdrawal, without non-consumer customers invoking other provisions of the Consumer Code.
The Buyer wishing to exercise the right of withdrawal must return the items purchased on www.molinel.com within the above-mentioned period, in their original packaging or a new box, complete and in new condition.
- Force Majeure
Molinel cannot be held responsible for the total or partial non-fulfillment of its obligations under this contract if such non-fulfillment is caused by a force majeure event, such as a disruption or total/partial strike of postal services, transportation and/or communications, flooding, fire, or other disasters.
Only events meeting the criteria established by the French Court of Cassation jurisprudence will be considered as force majeure.
In the event of a force majeure situation, Molinel will notify the Buyer within 5 business days following the occurrence or threat of such an event. The Parties shall then consult promptly to determine together the modalities for executing the order during the force majeure period.
If the interruption due to force majeure exceeds 1 month, Molinel may be unable to fulfill the order. In such a case, Molinel may terminate the ongoing order, with the obligation to refund the Buyer if applicable.
9. Entire Agreement
These General Terms and Conditions of Sale and the order summary provided to the Buyer form a contractual whole. They constitute the entire contractual relationship between the Parties. In case of any conflict between these documents, the Molinel General Terms and Conditions of Sale shall prevail.
Invalidity of a Contract Clause
If any provision of these General Terms and Conditions of Sale is declared invalid, such invalidity shall not affect the validity of the remaining provisions, which shall remain in force between the Parties.Modification of the Contract
Any amendment, termination, or waiver of any clause of this Contract shall only be valid if agreed upon in writing and signed by both Parties.Non-Waiver
The failure of one Party to enforce an obligation of the other Party under these Terms shall not be interpreted in the future as a waiver of that obligation.Notifications
All notifications under this Contract shall be considered effectively made if sent by registered mail with acknowledgment of receipt to the following address:

10. Applicable Law and Jurisdiction
The General Terms and Conditions of Sale are governed by French law.
Any dispute arising from the formation, interpretation, or execution of this contract shall be subject exclusively to the courts of Roanne, notwithstanding multiple defendants or third-party claims, unless otherwise mandated by public order.
These Terms and Conditions apply for the entire duration of the online availability of products offered by Molinel.
